ISLAMABAD: Pakistan Justice & Democratic Party (PJDP) of the former Chief Justice of Pakistan Iftikhar Muhammad Chaudhry has decided to approach Speaker National Assembly for sending reference to Election Commission of Pakistan for disqualification of Prime Minister Mian Nawaz Sharif.

Giving details of the reference against Mian Nawaz Sharif during a press conference on Saturday here, Chaudhry disclosed that on August 08, 2016, the NA Speaker would be asked for making reference to the ECP on behalf of former parliamentarian Al Haaj Sardar Umer Farooq Khan against Mian Nawaz Sharif from NA-120 Lahore-III under Article 63 (2) of the Constitution.

Chaudhry said, “Essentially the petitioner’s case is not covered under Article 63(a)(B)(e)(d)(f) and (i) of the Constitution, as the questions, are arising, because of concealment of property outside Pakistan and evasion of taxes, money laundering, abuse of SRO culture, clearance of borrowed amount of Rs.6.146 billion, benefits drawn unauthorisedly by misusing his position as chief minister, misstatement about assets of land in nomination papers in elections, non-disclosure of pendency of criminal references, for misusing the official sources, favouritism and nepotism, massive rigging in the general election of 1990, fabrication, breach of confidentiality of agreement, violation of constitution, evasion of income tax, etc”.

“His case is compassed by Article 62(1)(f) the of the Representation of People Act 1976, violation of Income Tax Act, Wealth Tax Act, Foreign Exchange Regulation, etc. Therefore it is imperative to send Reference to the ECP inter alia on the questions which have been noted blow for Probe and determination,” the former Chief Justice of Pakistan said.

He said many questions arose under Article 62(1)(f) and law for determination of disqualification of Mian Muhammad Nawaz Sharif, MNA/Prime Minister; i) Whether Mian Muhammad Nawaz Sharif is an Ameen or has ceased to be an Ameen? ii) Whether Mian Muhammad Nawaz Sharif is a Sadiq person or has ceased to be a Sadiq person? iii) Whether in view of disregard and violation of law and Article 5 of the Constitution, Mian Muhammad Nawaz Sharif can be trusted to remain a Member of the National Assembly and the Prime Minister of Pakistan and run affairs of the State in accordance with the Constitution & Law?

Chaudhry maintained that under the reference it would be submitted that questions noted hereinabove to disqualify Mian Muhammad Nawaz Sharif, MNA, NA-120-III/Prime Minster may expeditiously be referred to the ECP for its decision with consequential relief as per Constitution and Law.
