ISLAMABAD: The Supreme Court on Tuesday rejected application of extension in bail before arrest of an accused who has been on bail for the two years.

National Accountability Bureau had filed a reference against Muhammad Ikhlaq Memon who allegedly purchased expensive property located at Teen Talwar Chowk, Karachi, at a throwaway price.

Memon is also facing National Accountability Bureau (NAB) reference over the alleged accumulation of assets beyond known sources of his income.

Taking up the NAB plea seeking Memon’s interim bail cancellation, a three-judge bench led by Justice Dost Muhammad Khan observed if a poor man can get interim bail for two years from the courts.

A member of the bench Justice Qazi Faiz Isa remarked if the court grants interim relief to the accused in the matter in hand, there is strong possibility that he will not appear before the court concerned till next Eid under one or the other pretexts.

Meanwhile, the same bench observed while hearing a matter relating to determination of inheritance that population of the country was growing but the government has not increased the numbers of trial court judges.

Justice Dost Muhammad Khan remarked that pendency in the subordinate courts due to shortage of the judges is one of the major reasons behind adjudication of a matter for decades, adding that some lawyers’ ‘kindnesses’ are also creating hurdles in the system.

He was of the view that fingers are being pointed at justice system of the country because in many cases those who filed the case for remedy were not able to hear the judgment in their lives.
