Indian Prime Minister Narendra Modi has an ‘Achilles heel’ somewhere, if only he can find it. The second death anniversary of Kashmiri freedom movement commander, Burhan Wani, took place soon after the imposition of governor’s rule on the Indian held Jammu and Kashmir. Normal life was disrupted in Indian held Kashmir in response to a strike called by freedom fighters to mark Wani’s second death anniversary while ‘authorities’ imposed harsh restrictions in parts of the held Valley. Clashes between the Indian forces and groups of youths trying to defy the illegitimate restrictions occurred at some places in Tral area, the ancestral town of Wani, who was martyred in a fake encounter in Kokernag area of Anantnag district on July 8, 2016. His martyrdom had triggered massive violent protests that left nearly 100 dead and countless more blinded by pellets fired at protestors by Indian troops. The pellet victims include a very large number of girls. Mobile internet services were suspended throughout occupied Kashmir as a repressive measure. Freedom movement activists and their leadership had given a call for a strike on Sunday across Kashmir on the second death anniversary of the Hizb commander. Indian troops martyred three stone-throwing protesters, including a 16-year-olf girl, ahead of the anniversary of the martyrdom of popular freedom fighter. The situation shows that nothing is working for New Delhi particularly after the release of a United Nations report that has rightly held it responsible for having used excessive force in held Kashmir to kill and wound civilians since 2016. Not only had the UN High Commissioner for Human Rights Zeid Ra’ad Al Hussein called for maximum restraint, he had also denounced the lack of prosecutions of Indian forces’ personnel in occupied Jammu and Kashmir due to a 1990 law giving them virtual immunity. The Narendra Modi coalition government at the centre is finding it extremely difficult to deal with growing protests in the held valley where the Kashmiris have been demanding their right to self-determination in accordance with the United Nations resolutions with dogged determination; Wani’s martyrdom has introduced new dynamics to their just struggle. They have been rendering countless sacrifices in this regard. India therefore must not lose sight of the fact that Zeid had also called for a commission of inquiry by the Human Rights Commission into all violations and a global investigation into the mass graves sites in the Kashmir Valley and Jammu. “Immediately remove the requirement for prior central government permission to prosecute security forces personnel accused of human rights violations in civilian courts. Impunity for human rights violations and lack of access to justice are key human rights challenges in the state of [Indian occupied] Jammu and Kashmir,” the report says, bringing under focus the fact that infamous AFSPA and Public Safety Act 1978 (PSA) have “created structures that obstruct the normal course of law, impede accountability and jeopardize the right to remedy for victims of human rights violations.” Be that as it may, not only has New Delhi rejected the UN report with sheer contempt and disdain, the far right media in India have even castigated Amnesty International India for welcoming this report. George Washington had famously said that “truth will ultimately prevail where there are plans taken to bring it to light”. India is now fully aware of the fact that the UN has decided to bring the truth to light. Zeid’s report constitutes the first major step towards making the world aware about the reign of terror that India has unleashed in the held Valley in order to perpetuate its unlawful, illegal and illegitimate rule in a territory that it has been occupying since the Partition of the sub-continent.
