NTC issues clarification about antidumping duty

KARACHI: National Tariff Commission (NTC) has issued clarification regarding antidumping duty against dumped imports of wall and floor tiles from China.

In a letter sent to the Model Customs Collectorate (MCC), Appraisement (West), the Federal Board of Revenue (FBR) apprised that the matter was forwarded to the NTC for clarification regarding antidumping duty against dumped imports of wall and floor tiles from China.

The NTC in its letter stated that the antidumping duties shall only be applied to products which enter into Pakistan for consumption on or after the date of publication of a notice of affirmative preliminary or final determination in an investigation.

It said that the goods were entered into Pakistan for consumption on release from warehouse. Therefore applicable antidumping duty would be charged on the date on which the goods were released. Furthermore, it said that section 51(C) of the Act empowered collection of antidumping duties as customs duties were collected; adding that section 30 and 30 (A) of the Customs Act 1969. It stated that the rate of customs duty applicable to any imported goods shall be the rate of duty enforce on the date on which the goods declaration for ex-bonding was filled with customs.

This provision of the Customs Act was similar to the section 56 of the Antidumping Duties Act 2015.
