RECORDER REPORT

KARACHI: Sindh Water Commission (SWC) on Saturday directed ABAD to approach Supreme Court (SC) on the issue of NOCs for construction of multistory building.

The commission in an order stated that the issue with regard to construction of multistory buildings in Karachi is pending before the Supreme Court, wherein SC has passed an order on January 14, 2018 that the builders can raise construction of parking plus six saleable floors.

The Chairman ABAD stated that inspite of this order only four NOCs have been issued by the Water Board. Since the issue raised before the commission is subjudice before the SC, proprietary demands that such issue need to be raised before the SC as Water Commission cannot intervene.

Order stated that Water Commission has not restrained the Water Board from issuing NOC nor could it direct the Water Board otherwise. The Water Board may issue NOCs subject to its rules.

However, if the ABAD has any issue with Water Board it can be raised by them by approaching the SC, order stated and added as far as the Water Commission is concerned, it is bound to implement directives of SC in terms of the orders passed at times and cannot take up an issue which is dealt with by apex court.
